  • Recitals – This section describes the who and where of the addendum.

    • The name, date of birth, and citizenship of the affiant is given; and

      • The affiant is the person that will be signing the affidavit. This is NOT the person whose birth is being proven through this affidavit. Rather it is an individual who has personal knowledge of the birth. 

      • In the best-case scenario, the affiant is one of the parents. But if neither parent is available, a relative, such as an older sibling or an uncle, a close family friend, or the attending physician of the hospital during the birth may act as the affiant.

    • The affiant’s place of residence is listed.

  • Sworn Facts – The next portion of the affidavit contains all of the facts the affiant is swearing are true in front of the witnessing authority.

    • The subject of the affidavit is identified;

      • The subject is the person whose birth details are being proven through this affidavit.

    • The relationship of the affiant and subject is specified;

    • The reason why the affiant has knowledge of the subject’s birth is given; and

      • For example, the affiant may have been at the hospital when the subject was born. Or maybe the affiant was the doctor that delivered the subject.

    • The reason why the affidavit is being created is provided.

  • Signatures – The affiant signs and date the affidavit in front of a witnessing authority, such as a notary public or judge.

Affidavits are taken very seriously. By executing the document, the affiant is representing all the facts contained within are true to the affiant’s knowledge. If the affiant knowingly falsifies information through this affidavit, they may be subject to perjury charges.
